1. General Terms &  Conditions

Welcome aboard! By booking a trip with Beyond Fishing Charters, you acknowledge and agree to the following terms:

1.1 Reservations  &  Deposits

  • A deposit is required to secure your reservation.
  • Deposits are non‑refundable within 7 days of the scheduled trip.
  • Full payment is due after the charter, unless otherwise arranged by Captain Zach Diaz.

1.2 Cancellations  &  Rescheduling

  • Trips may be rescheduled due to unsafe weather or sea conditions at Captain Zach’s discretion.
  • If a trip is rescheduled by Beyond Fishing Charters, your deposit will be applied to the new date.
  • If you cancel outside the 7‑day window, you will forfeit your deposit.
  • If you cancel within 7-day window or fail to show, you forfeit your deposit.

1.3 Arrival  &  Punctuality

  • Guests must arrive at the dock/pick‑up location at least 15 minutes before departure.
  • Late arrivals may result in deduction of time or forfeiture of the trip at the captain’s discretion.

1.4 Behavior  &  Safety

  • Guests must follow all safety instructions provided by Captain Zach.
  • The captain reserves the right to remove any guest whose behavior endangers themselves or others without refund.
  • Alcohol consumption is permitted only as allowed by law and under the captain’s discretion. Excessive use may result in removal from the vessel without refund.

1.5 Weather &  Environmental Conditions

  • Fishing charters operate in natural conditions that may change suddenly (wind, seas, storms, tides).
  • Beyond Fishing Charters may cancel, shorten or modify a trip at any time for safety reasons without liability.
  • You agree that safe passage and weather decisions rest with Captain Zach, and you hold Beyond Fishing Charters harmless for weather‑related changes.

1.6 Equipment, Included Items & Rates

  • Trip rates (as listed on the website) include fuel, fishing licenses, cooler w/ bottled water & ice, rods, tackle, bait, and USCG‑approved safety equipment for up to 4 people. 
  • Tip for the captain (20% customary) is not included but appreciated.
  • Any additional persons beyond the listed “up to 4 people” may incur extra charges; confirm when booking.

1.7 Pickup Locations

  • Pickup services are arranged throughout the Tampa Bay area, including Tampa (Gandy Boat Ramp), St. Petersburg (Municipal Marina & Maximo Park), and Ruskin (Little Harbor Marinas).
  • If a custom or alternative pickup is requested, additional fees may apply.

2. Assumption of Risk &  Waiver of Liability

Participation in fishing, boating, and related activities involves inherent risks, including but not limited to:

  • Slips, trips, or falls on the vessel;
  • Injuries from fishing equipment, hooks, rods, reels;
  • Seasickness, adverse reactions to weather, water, or sea‐life;
  • Collisions, equipment failure, or marine hazards;
  • Changing ocean/sea/tide/wind conditions;
  • The acts or omissions of other passengers or marine craft.

By booking and participating in a trip with Beyond Fishing Charters, you voluntarily assume all such risks, whether known or unknown. You agree to release, waive, and hold harmless Beyond Fishing Charters LLC, Captain Zach Diaz, and any affiliated crew or agents, from any and all claims, liabilities, damages, costs or expenses (including attorney’s fees) arising from your participation, except in cases of gross negligence or willful misconduct.

3. Participant Acknowledgment

By checking the booking confirmation box, completing the reservation, or boarding the vessel, you acknowledge that you have:

  • Read and understood these Terms & Conditions;
  • Voluntarily accepted the inherent risks of the trip;
  • Reserved your trip under these conditions;
  • Agreed to release Beyond Fishing Charters LLC from liability as set forth above.

4. Minors

  • Guests under 18 years old must have a parent or legal guardian sign the waiver on their behalf and remain responsible for the minor at all times.
  • Beyond Fishing Charters LLC and Captain Zach are not responsible for supervising minors beyond standard safety procedures.

5. Emergency Contact

When booking your trip, you must provide an emergency contact name and telephone number. This contact is to be reachable in the event of an incident. Failure to provide a valid emergency contact may result in denial of boarding or trip cancellation without refund.

6. Group &  Special Event Trips

Beyond Fishing Charters offers trips suitable for business groups, parties, family gatherings, and special events. These trips are subject to all terms here, plus any additional terms provided at booking (e.g., group size, custom itinerary, extra crew). All standard cancellation, behavior, and safety rules apply.

7. Governing Law &  Severability

  • These Terms & Conditions are governed by the laws of the State of Florida.
  • If any provision of this agreement is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
  • No waiver of any of the rights hereunder shall operate as a waiver of any other right, or of the same right on another occasion.
